Lawsuit Could Begin To Close ‘LLC Loophole’ For Campaign Donations

ALBANY — A lawsuit could potentially make a significant dent in the so-called LLC loophole that lets some people and businesses significantly surpass New York’s campaign contribution limits.
As POLITICO reported in April, donors like the New York City Deputy Sheriff’s Association gave Shirley Patterson’s unsuccessful campaign for an Assembly seat in Brooklyn — topping both the $4,100 contribution limit that existed at the beginning of the year and the inflation-adjusted $4,400 limit that was scheduled to take effect in February.
This week, the Times Union’s Chris Bragg reported that Board of Elections enforcement counsel Risa Sugarman had sued the Patterson campaign last month in an Albany court, arguing that some $5,000 donations were clearly over the legal limit and seeking both civic penalties and $10,000 fines.
